EmailCommand.com Acceptable Use Policy

Effective 1/1/2002

By using any of the EmailCommand.com services that may be available to you on or through this site, you agree that you will only use the services for lawful purposes and that you will not take any action in violation of this Acceptable Use Policy as described below:

Illegal Activities and Harrassment

You will not use the services to transmit, distribute or store any content that is unlawful (under any applicable state, federal or foreign law, regulation or court action), threatening, abusive or harassing (on the basis of religion, gender, sexual orientation, race, ethnicity, age, or disability or otherwise), defamatory, libelous, deceptive or fraudulent, invasive of another's privacy, tortious, or otherwise in violation of EmailCommand.com's rules or policies, including this Acceptable Use Policy, or the EmailCommand.com's Terms of Service. You will not use the Services to impersonate any person or entity, military official, government employee, or any employee or representative of EmailCommand.com.

Infringement

The services may not be used to infringe on any patent, trademark, trade secret, copyright, right of publicity or other proprietary rights, and you agree not to transmit, distribute or store any infringing content of any nature using the services.

Bulk E-mail

You agree that you will not use the services to conduct unauthorized or unsolicited advertising, junk or bulk email (also know as "spam"), chain letters, any other form of unauthorized solicitation or any form of lottery or gambling.

With prior authorization from EmailCommand.com as described below, the services may be used to send "opt-in" mailings. "Opt-in" mailings means that the recipient has voluntarily signed up to receive mailings voluntarily and that the mailing is not spam. Opt-in mailings to 250 or more must be authorized by EmailCommand.com before they are sent using the Services. Customer wishing to send opt-in mailings should contact operations staff at support@emailcommand.com not less than 72 hours prior to intended mailing.

Viruses

You will not use the services to transmit, distribute or store any software viruses or any other computer code, files or programs that are designed or intended to disrupt, damage or limit the functioning of any software, hardware or telecommunications equipment or to damage or to obtain unauthorized access to any data or other information of any third party.

Privacy of Other Users

You also agree that you will not harvest or collect information about the users or members of the services or use such information for the purpose of transmitting or facilitating transmission of unsolicited bulk electronic e-mail or communications. You further agree that you will not knowingly solicit or collect personal information (including without limitation name, address or phone number) from anyone under the age of 16.

You are responsible for ensuring that the services you obtain from EmailCommand.com are used in an appropriate manner and in compliance with EmailCommand.com's policies. You must take steps to control your passwords, access, and all use of the services through your account in such a way that abuse does not occur. In the event your account is used in violation of this Acceptable Use Policy, EmailCommand.com retains the right to disable your account and disallow you further service.
